The enforcement, construction, and adjudication of all matters arising from or related to this Agreement shall be governed by, construed, and adjudicated **exclusively** in accordance with the substantive and procedural laws of the **Republic of India**.
All disputes, claims, or controversies of any nature arising out of or relating to this Agreement, including any question regarding its existence, validity, or termination, shall be first and finally settled by **mandatory, conclusive, and binding arbitration** under the provisions of the Arbitration and Conciliation Act, 1996, and its subsequent amendments. The venue, seat, and legal place of the arbitration shall be **Morbi, Gujarat, India**. The User explicitly, formally, and **irrevocably waives their right to initiate or participate in any class action lawsuit or pursue any remedy other than binding arbitration**, agreeing that arbitration is the sole and exclusive legal remedy for dispute resolution.
Only in the extremely limited and residual event that the mandatory arbitration clause is found to be legally unenforceable by a competent Indian court, any and all subsequent legal actions, suits, or proceedings shall be submitted to the **exclusive jurisdiction** of the courts having original jurisdiction over Morbi District, Gujarat, India, specifically the **Morbi District Court** and the **Ahmedabad High Court**.
